Hey everyone,

I've been reading the website a lot lately, as I've been thinking of suing Dishnetwork for violation of the TCPA. However, I wanted to get some feedback from some people more experienced than myself (namely you all(I hope!)).

Over the last four months, after moving into my new apartment with my girlfriend, I have received over 10 solicitations from Dishnetwork trying to get me to switch to their service. I tried informing them that I was not interested, I tried telling them I couldn't get dish service at my apartment. After probably the first 3 or four calls I started to do some research, and thats when I stumbled onto this website. I used the Do Not Call script and informed them on more than 3 occassions my wishes to be added to their do not call list, and then asked to be transfered to their supervisor so that I could request a do not call policy. Each time I was disconected.

However, much to my elation, it seemed the calls had stopped!

But on September 7th, at 1:03 PM, guess who decided to interrupt my pleasant afternoon at home.. you guessed it my good friends at Dishnetwork.

This time I told them that I demanded a copy of their do not call policy and that I demanded to be placed on their do not call list. I want to sue them but

A. I'm not sure exactly what i'm entitled to under the TCPA

B. I'm not sure what a "reasonable" amount of time to wait for their do not call policy would be.

C. I'm not sure how to kick off the lawsuit process in small claims court.

Sorry about the lengthy post but if anyone who has had some success suing a telemarketer could offer some of their wisdom they would have my never ending gratitude.

Well PO as you may or may not know you must re-register every year to stay on the list otherwise you could be called. By law they have to take you off their list if you request it. Sounds to me like they are in violation of the law from what I read in your post.

I would immediately send them a certified CEASE and DESIST letter to their corporate headquarters. Very effective believe me. Let them know that you do not want any of their useless promotions through any means whether it's by phone (cell or landline), fax, email, regular mail, telegram or telegraph. If they continue calling you then you will consider it harrassment and a lawsuit will follow. Make sure you have all the important information in the letter (name address, phone etc) and document the times they call you.
