It's becoming pretty clear that many states just aren't interested in enforcing the new no-call list.

While the FTC keeps a list of complaints, it seems to be up to state attorneys general to clamp down on telepests. And most don't care.

Lately, I've seen a dramatic rise in telepest calls. Many from mortgage companies - they're always on the front lines of scumdom since they get a high commission for relatively little work. And many with illegally hidden caller ID information.

I've contacted local state senators and gotten no response on this issue. What else can we do to get the government to enforce the law?

I filed two complaints on DNC against California Pacific Mortgage, which was investigated, busted but not fined. And the Las Vegas/Time share company which was busted for over 300,000 illegal calls, but will they be let off the hook too?

Dealt with MCI's incessant calls and bogus long distance charges for trying to get them to stop calling me. Worked until our area code split then had to start all over.

I am getting bugged by regular calls from an unidentified on Caller ID dialer. Difficult to file a complaint against that one.

I say, bust them and fine them.

wink.gif Well folks I'm new to this site, however I'm not new to telemarketing. Do Not Call list?? It has become an inside joke to most marketers. If you don't say it politely or if you piss one of them off you will definately get another call. Even if you are dispositioned properly to be put on the list, the predictive dialer will put you back in. Management feels if that rep doesn't get a sale from you the next one will. I'm the job hopper..looking for a legal AND ethical marketing job. I concluded this day they just aren't around. I do want to raise a subject though..think about what these practices are doing to our young people. Making Cons out of them before they are even 18. They see easy money and have not developed the work ethic to resist. Or they simply don't work with eyes and ears open. Music is played sooo loud that you really have to concentrate on a call. A sale at any cost. I worked for Suntasia years ago and as I've been job hopping since that time they have really grown. I recently went to their new head quartes. Beautiful bulding but the same old scam shit. Needless to say I'm not employed today.

We all seem to forget the feds are just one place to complain. The federal code gives you the right to sue in your state's court, regardless of what state the call orginates from and many states now have laws that specificy statuatory awards, which means all you have to do is prove the company broke the law, the issue of damges is already settled. Most states also have clauses in their civil codes that allow for increased awards should the actions of the company be proven willful.

Get the right judge and you could find the company owners and even the person who actually called you squirming in front of him. Frozen assets, liens, all sorts of fun can be had.


Even if the feds do take action on your complaint, your ignoring the real weapon you have in your individual right to sue.

Actually, Suntasia just started charging $50 to every rep for their own telemarketing license. That way when you're pressured to lie for sales...they are covered. You lie..you loose either way they protect themselves.
